Welcome to LuxuStars. These Terms and Conditions (“Terms”) govern your use of the LuxuStars Platform (luxustars.com) and any associated mobile applications. By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy. Your electronic acceptance of these Terms constitutes a legally binding agreement between you and LuxuStars.
These Terms constitute a binding agreement between you and LuxuStars (“LuxuStars,” “we,” “us,” or “our”). If you do not agree to these Terms, you may not access or use the Platform.
LuxuStars operates an online marketplace that connects Travelers with independent service providers offering luxury accommodations, vehicles, watercraft, and curated experiences. LuxuStars is not itself a provider of these services, but acts as an intermediary to facilitate Bookings and payments between Users and Providers.

For the purposes of these Terms:
LuxuStars provides an online marketplace where Travelers can discover and book accommodations, vehicles, watercraft, and curated experiences offered by independent Providers.
You acknowledge that LuxuStars acts only as an intermediary between Travelers and Providers. LuxuStars does not own, operate, or manage any accommodations, vehicles, watercraft, experiences, or other Services listed on the Platform. All Bookings are made directly with the independent Providers, who are solely responsible for delivering their Services and complying with all applicable laws and regulations. LuxuStars is not responsible for ensuring that Providers comply with any legal requirements, and Travelers are solely responsible for doing their own due diligence on Providers before making a Booking.
LuxuStars screens and verifies Providers to enhance trust and safety but does not guarantee the quality, safety, legality, or suitability of any Provider’s offerings. LuxuStars disclaims all liability for Services provided by Providers or any disputes between Users and Providers. In case of a dispute, LuxuStars' role is limited to facilitating communication or, at its discretion, helping with dispute resolution; LuxuStars is not responsible for any losses, damages, or claims arising from such disputes.
You agree that LuxuStars is not a party to any contract between you and a Provider, and that you assume all risks associated with using the Platform and engaging with Providers.
To use the Platform, you must be at least 18 years old and capable of entering into legally binding agreements. By creating an account, you represent and warrant that you meet these requirements and agree to provide proof of eligibility upon request by LuxuStars.
You agree to provide accurate, current, and complete information during registration and to keep your account details updated. Providing false or misleading information may lead to suspension or termination of your account and other legal actions. LuxuStars may require you to undergo identity verification, including submitting government-issued identification or other documentation, to help maintain trust and safety on the Platform. You are not allowed to create or maintain multiple accounts unless expressly authorized by LuxuStars.
You are responsible for keeping your account credentials confidential and for all activities conducted through your account. You agree to notify LuxuStars immediately if you suspect any unauthorized use of your account, compromise of your credentials, or other security issues.
You acknowledge and agree that LuxuStars may keep certain account data after suspension or termination as needed to comply with legal obligations, regulatory requirements, or legitimate business purposes.
LuxuStars reserves the right to suspend or terminate your account at its discretion if it believes you have violated these Terms, engaged in fraudulent activity, or compromised the safety or integrity of the Platform.
The Platform allows Travelers to browse, request, and confirm Bookings with Providers offering accommodations, vehicles, watercraft, and curated experiences. By making a Booking through the Platform, you agree to pay all applicable charges, including the listed price, service fees, taxes, and any other costs shown during checkout. Providers may have additional requirements, conditions, or approvals for Bookings, such as minimum stays, security deposits, or verification steps, which will be disclosed in the listing or during the Booking process.
All reservations are confirmed instantly through the Platform if the selected dates are available and payment is successfully processed. Providers do not review or approve bookings individually. Once payment is completed, the Booking is automatically confirmed.
Payments are processed through third-party payment processors such as Adyen, Stripe, and PayPal. You authorize LuxuStars and its payment partners to charge your chosen payment method for all amounts owed related to your Bookings. Currency conversions and associated fees may apply depending on your payment method and location. If your payment fails or remains incomplete, LuxuStars may suspend or cancel your Booking, and you could be responsible for any resulting fees, penalties, or losses. LuxuStars reserves the right to recover unpaid amounts by charging your payment method or using other lawful methods. Currency conversion rates are set by the applicable payment processor or your payment provider and will be disclosed at checkout before you complete your Booking.
You are responsible for understanding and complying with any applicable rules, restrictions, or requirements set by the Provider, including check-in procedures, security deposits, or local regulations. Unless otherwise stated, LuxuStars’ service fees are non-refundable if you cancel, except as required by law or as explicitly stated in the cancellation policy at the time of Booking.
LuxuStars facilitates payments between Travelers and Providers through third-party payment processors such as Adyen, Stripe, and PayPal. When you book on the Platform, you authorize LuxuStars and its payment partners to charge your selected payment method for all amounts due, including the listing price, service fees, applicable taxes, and any other charges shown during checkout. Payment processing times can vary depending on your payment provider. LuxuStars is not liable for any errors, delays, or failures caused by third-party payment processors. If you have a payment dispute, you must resolve it directly with your payment provider.
You acknowledge that LuxuStars is not a bank or escrow agent and does not hold funds on behalf of Users or Providers. Payment processing is subject to the terms, conditions, and privacy policies of the applicable payment processor.
Service fees and commissions charged by LuxuStars will be disclosed during the Booking process. LuxuStars reserves the right to modify service fees at any time, with such changes applying prospectively.
You are responsible for all applicable taxes, duties, and other government charges related to your Bookings. Unless otherwise stated, LuxuStars does not collect or remit taxes on behalf of Users or Providers; you are solely responsible for determining and satisfying any tax obligations arising from your use of the Platform. Currency conversion rates and foreign transaction fees may be charged by your payment provider.
The price displayed to Travelers at checkout is inclusive of all service fees. LuxuStars’ service fees or commissions are disclosed separately to Providers during the listing process or onboarding. LuxuStars accepts major payment methods, which may include Visa, Mastercard, American Express, Diners, Discover, PayPal, and other locally supported options as displayed at checkout.
LuxuStars reserves the right to verify your payment method, which may involve pre-authorizations, nominal charges, or other verification methods to reduce fraud. If verification fails, your Booking may be suspended or canceled. We may also cancel or suspend any Booking or account that shows signs of fraud, abuse, suspicious activity, or violation of these Terms.Certain banks or card issuers may charge fees for international or cross-border transactions, currency conversion, or other related services. LuxuStars is not responsible for such fees. Travelers are encouraged to check with their payment provider for details.

LuxuStars provides a framework for Providers to set their own cancellation and refund policies. When you make a Booking through the Platform, you agree to be bound by the applicable Provider’s cancellation and refund policies as outlined in the listing or in our Help Center. Cancellations or changes initiated through the Platform are automatically processed according to the selected Provider cancellation policy, with applicable charges or refunds applied automatically by the system.
You are responsible for reviewing the cancellation and refund policy that applies to your Booking before confirming your reservation. Refund eligibility, amounts, and timelines depend on the specific policy chosen by the Provider.
If you fail to cancel your Booking in accordance with the applicable cancellation policy and do not arrive for your reservation (i.e., no show), you will not be eligible for any refund.
LuxuStars reserves the right to change its general cancellation policies at any time. Notice of material changes will be provided by updating the Help Center or these Terms.
In certain cases, LuxuStars may intervene to assist with cancellations, refunds, or dispute resolution at its discretion, but LuxuStars does not guarantee refunds beyond what the applicable Provider’s policy allows. In exceptional circumstances, LuxuStars may, at its sole discretion, offer limited refunds or credits to Users, even if not required by the Provider’s policy.

You agree to use the Platform only for lawful purposes and in accordance with these Terms. Examples of lawful use include Booking accommodations through the Platform, communicating with Providers or Travelers about listings, and submitting reviews or feedback in good faith.
You must not:
LuxuStars reserves the right to investigate and take any appropriate action, including suspension or termination of accounts, reporting to law enforcement or regulatory authorities, or pursuing legal action for violations of these rules. If you become aware of any violation of these Terms, you may report it to LuxuStars for review and potential escalation.
8.1 Platform Content. The Platform contains a wide variety of content and materials, including but not limited to text, graphics, logos, software, images, audio, video, design elements, databases, and other intellectual property, all of which are owned by or licensed to LuxuStars. These materials are protected by applicable intellectual property laws, such as copyright, trademark, and trade secret laws, as well as international treaties. Except as stated in our Provider Agreement, LuxuStars grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform and its content strictly for your personal, non-commercial use, and only in accordance with these Terms. You may not copy, reproduce, modify, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any content or materials from the Platform without prior written permission from LuxuStars or the applicable rights holder. This license can be revoked by LuxuStars at any time, at its sole discretion, and any unauthorized use of the Platform's content may lead to termination of your access and possible legal action. All rights not explicitly granted here are reserved by LuxuStars and its licensors.
8.2 Provider Content. Providers retain ownership of the content they upload to the Platform, including listing descriptions, photos, and other materials. By uploading or posting content, Providers grant LuxuStars a worldwide, royalty-free, sublicensable license to use, display, reproduce, modify, adapt, distribute, edit, moderate, and promote such content for the purpose of operating, promoting, or advertising the Platform. Providers may request the removal of their content from the Platform by contacting LuxuStars at https://luxustars.com/contact-us. LuxuStars will review such requests and may remove content at its discretion, subject to legal or contractual obligations. Providers represent and warrant that their content does not infringe or violate the rights of any third party, including intellectual property, privacy, or publicity rights.
8.3 User-Generated Content. If you post reviews, messages, or other content on the Platform, you grant LuxuStars a non-exclusive, royalty-free, worldwide license to use, display, edit, moderate, promote, advertise, and distribute that content in connection with the Platform. You may request the removal of your content by contacting LuxuStars. LuxuStars will review such requests and may remove content at its discretion, subject to legal or contractual obligations. You represent and warrant that you have all necessary rights to grant this license and that your content does not infringe or violate the rights of any third party, including intellectual property, privacy, or publicity rights.
8.4 Copyright Complaints. LuxuStars respects the intellectual property rights of others and is dedicated to addressing claims of copyright or other IP violations according to applicable law. If you believe any content on the Platform infringes your copyright or other intellectual property rights, please contact us by providing a written notice that includes: (a) a description of the copyrighted work or other intellectual property that you claim has been infringed; (b) a description of where the allegedly infringing material is located on the Platform (including a URL or other specific location); (c) your name, address, phone number, and email; (d) a statement that you have a good faith belief the disputed use is unauthorized by the rights holder, its agent, or the law; (e) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act on behalf of the owner; and (f) your electronic or physical signature. Send your notice to our designated contact. LuxuStars may remove or disable access to content that, in our sole discretion, violates the rights of others, and may terminate the accounts of repeat infringers in accordance with applicable law.
8.5 Reviews and User-Generated Content. LuxuStars encourages honest, helpful, and respectful reviews and contributions from Users. By submitting reviews, photos, comments, or other content, you agree to:

Technical Guidelines
LuxuStars reserves the right to moderate, edit, remove, or reject any content that violates these guidelines or our policies. Providers may respond to reviews left by Travelers but may not communicate directly through the Platform to resolve disputes. Reviews are published regardless of whether they are positive or negative, provided they comply with these guidelines.
LuxuStars does not offer or guarantee any insurance coverage for Travelers or Providers. LuxuStars is not an insurer or insurance broker and does not act as such. LuxuStars may, in the future, introduce or facilitate the availability of insurance products for Travelers or Providers. Any such offerings will be governed by separate terms and conditions. While LuxuStars may facilitate or display information about insurance products in the future, any such insurance will be offered by third-party providers and will be subject to their terms and conditions.
Travelers and Providers must provide proof of valid insurance coverage upon request by LuxuStars, including but not limited to insurance for accommodations, vehicles, watercraft, experiences, personal liability, or other relevant risks.
Travelers and Providers are solely responsible for assessing their need for and obtaining appropriate insurance coverage for accommodations, vehicles, watercraft, experiences, personal liability, or other risks related to their activities. Proof of such insurance must be provided to LuxuStars upon request.
TO THE MAXIMUM EXTENT ALLOWED BY LAW, LUXUSTARS DISCLAIMS ALL LIABILITY FOR ANY DAMAGES, LOSSES, LOST PROFITS, LOST DATA, OR INJURIES RESULTING FROM YOUR USE OF THE PLATFORM, INTERACTIONS WITH OTHER USERS OR PROVIDERS, OR SERVICES BOOKED THROUGH THE PLATFORM. LUXUSTARS IS NOT RESPONSIBLE FOR THE CONDITION, LEGALITY, SAFETY, OR SUITABILITY OF ANY PROVIDER’S OFFERINGS.
IN NO EVENT WILL LUXUSTARS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS OR DATA. LUXUSTARS’ TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM WILL NOT EXCEED THE TOTAL AMOUNT YOU PAID THROUGH THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms limits or excludes any statutory consumer rights that cannot be lawfully limited or excluded.
You use the Platform at your own risk. The Platform and all content, features, and services are provided “as is” and “as available,” without warranties of any kind, either express or implied. LuxuStars does not guarantee that the Platform, its services, or any features will always be available, uninterrupted, secure, or error-free, or that they will meet your requirements or expectations at all times. It is your responsibility to verify that the Platform and any Services, content, or information obtained through it are suitable for your intended use before relying on or utilizing them.
LuxuStars makes no representations or warranties about the accuracy, reliability, availability, or suitability of the Platform or any listings, including the condition, legality, safety, or quality of Services offered by Providers. LuxuStars does not warrant, endorse, or guarantee any information, content, or Services provided by third parties, including Providers, or any information made available through the Platform by third parties.
LuxuStars does not guarantee continuous, uninterrupted, or secure access to the Platform. Access may be interrupted or unavailable due to maintenance, technical issues, or other reasons outside LuxuStars’ control. If you are dissatisfied with the Platform, its content, or any Services, your sole and exclusive remedy is to stop using the Platform.
To the maximum extent permitted by law, LuxuStars disclaims all warranties, whether express or implied, including any warranties of merchantability, fitness for a particular purpose, and non-infringement.
You agree to defend, indemnify, and hold harmless LuxuStars, its affiliates, directors, officers, employees, and agents from and against any claims, demands, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
LuxuStars reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with LuxuStars in asserting any available defenses.
These Terms are governed by and construed in accordance with the laws of the the laws of the State of Delaware, United States, without regard to its conflict of law principles.
LuxuStars provides an internal Resolution Center to help Travelers and Providers resolve disputes by submitting evidence and negotiating an agreement. If the parties cannot reach a resolution through this process, LuxuStars may review the evidence and issue a final decision at its discretion.
Before initiating any formal dispute proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to this Agreement, your use of the Platform, or any transaction conducted through the Platform through LuxuStars’ internal Resolution Center process. This process requires you to submit the dispute through the Platform and engage in good faith efforts to resolve the matter informally for at least thirty (30) days.
If the dispute is not resolved through the Resolution Center process, it shall be resolved by binding arbitration administered by JAMS in accordance with its Commercial Arbitration Rules and, if applicable, the JAMS Consumer Arbitration Rules. The arbitration will be conducted in English and take place in Wilmington, Delaware, United States, unless you and LuxuStars agree otherwise in writing.
You and LuxuStars agree that any arbitration shall be conducted only in your or LuxuStars’ individual capacity and not as a class action or other representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
You consent to the exclusive jurisdiction and venue of the state and federal courts located in the State of Delaware, United States, for any actions that are not subject to arbitration.
This Dispute Resolution section will survive the termination of this Agreement.
LuxuStars reserves the right to modify or update these Terms at any time in its sole discretion. If we make material changes, we will notify you by updating the date at the top of these Terms and, when appropriate, by email or through the Platform.
Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform.
LuxuStars may, in our sole discretion, suspend or terminate your access to the Platform at any time and for any reason, including if we believe you have violated these Terms, engaged in fraudulent activity, or compromised the safety or integrity of the Platform.
You may terminate your account at any time by closing your account through your account settings in the Platform and ceasing to use the Platform.
Upon termination, your right to use the Platform will end immediately. The provisions of these Terms that by their nature should survive termination will continue to apply, including but not limited to limitations of liability, disclaimers, indemnification, and governing law.
The Platform may contain (or you may be sent via the Platform) links to other websites (“Third-Party Websites”) as well as content belonging to or originating from third parties (“Third-Party Content”). LuxuStars does not investigate, monitor, or guarantee the accuracy, completeness, or appropriateness of any Third-Party Websites or Third-Party Content. Inclusion of or linking to any Third-Party Services does not imply approval or endorsement by LuxuStars.
Your use of such services is at your own risk and subject to their own terms and policies. Any purchases you make through Third-Party Websites are solely between you and the applicable third party, and LuxuStars takes no responsibility for such transactions. You acknowledge and agree that LuxuStars is not responsible for any losses or harm resulting from your access to or use of Third-Party Services.
If you access the Platform via a mobile application, LuxuStars grants you a revocable, non-exclusive, non-transferable, limited license to install and use the app on your device strictly in accordance with these Terms. You agree not to:

These Terms may be translated into other languages for your convenience. In case of any conflict or inconsistency between different language versions, the English version shall be considered authoritative and controlling.
LuxuStars will not be liable for any failure or delay in performing its obligations under these Terms due to events beyond its reasonable control, including but not limited to natural disasters, government actions, labor disputes, internet or communications failures, power outages, or other force majeure events.
By using the Platform, you consent to receive electronic communications from LuxuStars, including agreements, notices, disclosures, and other communications. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. You also consent to the use of electronic signatures and records for transactions conducted via the Platform.
LuxuStars may maintain certain data you transmit to the Platform to manage its performance, as well as data relating to your use of the Platform. While LuxuStars performs regular backups, you remain solely responsible for all data you transmit or that relates to any activity you undertake using the Platform. LuxuStars is not liable for any loss or corruption of such data, and you hereby waive any right of action against LuxuStars arising from any such loss or corruption.
If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed as necessary so that the remaining provisions remain in full force and effect. These Terms, along with our Privacy Policy and any other policies or guidelines incorporated by reference, make up the entire agreement between you and LuxuStars regarding your use of the Platform.
